Anyone who has any knowledge of this subject? Just out of curiosity. By subliminal I intend flashing images hiding a message for the purposes of advertising.

Depends on what they are saying/the meaning behind them I reckon. If they are just a bit of fun, I think there is no harm? :lol2: Advertising is a no-no I would guess.

I didn't think you were after FTI, I just noticed this topic came up after one of his entries had a little message in the corner, after I saw his Avatar and found it funny. :lol2: Shows how shallow I am. :lol2: Anywho [ :P ] ... yes. :help: I've forgotten what else I wanted to say.

I am with you all the way FTI. Broadcasting law would probably apply to advertising on the net, because epublishing would be defined as a cable service.
Just looking for loopholes, one of which is definitely to be consentient.
If anyone has any knowledge of any limitations on this issue please post them.

But isn't all advertising subliminal in a way? Companies have colors broken down to know which colors make you hungary, which colors apeal to which age groups, etc. Pretty much every commerical you see on tv, banner ads on the internet, even logos, have a bit of subliminal ideas in them....

Absolutely, that's why I ask where is the limit, where has the law/industry drawn the line. If anyone cares to fill us in on this it would simply be ... sublime.

I'm not clear on where the law stand in regards to this, but I'm quite certain the content of the subliminal message is more important than than it existing in the first place.
Examples: Almost every department store/mall in America employs the music of Muzak, Inc - regular songs with audible subliminal messages intended to prevent theft. Horror movies use 1-frame pictures of some disturbing scene (i.e. a cow being massacred) to make you more frightened and inwardly disturbed.
It's all about context and intent. In other words - don't go Fight Club with it :D
I'll rephrase this. They are illegal if they prmote any type of spending at your location, if they purposely make customers feel indifferently to competetitors, or if the customers are not alerted upfront that you use them.
Of course, this is the law for retail outlets, but I can't see it being very different online.

So grocery stores usually use specific types of 'soothing' and other kind of music, which 'subliminaly' effects the customer, and reportedly raises purachase rates. Isn't that what you just said was illegal to do?
No, because all elements of the music are understandable by our conscience mind. It's when they make the words "I am an honest person, I do not steal things" (true case) appear in the music in a way that we can't consciencely hear them that it becomes illegal.

go ahead post in net, but this is a designer/client forum. It is called DESIGN OUTPOST it is design related. We do not care to buy presciption drugs, counterfeits, view any type of picture 'yuck', bootlegs, copies, wannabes..... so please...THIS not a 'place' to post spam....do not post it.
